Section 1 – Introduction & Acceptance
Welcome to SoFlo Pros LLC dba BestNest Cleaning (“BestNest Cleaning,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern the use of our residential cleaning services (“Services”).
By booking, scheduling, purchasing, or using our Services, you agree to be bound by these Terms.
Section 2 – Quotes & Scope of Work
All quotes are estimates based on the information provided by the customer and the anticipated scope of work. Additional charges may apply if the condition, size, or complexity of the project differs materially from what was originally represented.
We will notify you of any material price increase before proceeding with additional work.
Section 3 – Performance of Services
BestNest Cleaning agrees to perform the Services listed in your quote or booking confirmation.
Arrival times are estimated and not guaranteed. Traffic, prior appointments, weather, staffing, and other operational issues may occasionally cause delays or rescheduling.
We reserve the right to assign or replace cleaning personnel at our discretion.
Customer agrees to provide safe and reasonable access to the property where Services are to be performed, including access to running water and electricity necessary to complete the Services.
If the property cannot be accessed at the scheduled appointment time, cancellation or lockout fees may apply.
Section 4 – Pricing & Payment
All prices are listed in U.S. Dollars.
We accept cash, credit cards, debit cards, and other approved payment methods. Credit card transactions may be subject to processing fees where permitted by law.
Invoices are due within forty-eight (48) hours unless otherwise agreed in writing.
Past due balances may accrue interest at a rate of 3% per month or the maximum amount permitted under Florida law.
Returned payments or declined transactions may incur an administrative fee of $50.
Section 5 – Recurring Cleaning Services
Recurring cleaning services automatically renew according to the selected service frequency until cancelled.
Customers may cancel recurring services at any time by providing notice through email or another approved communication method. Cancellation requests should be submitted at least twenty-four (24) hours before the next scheduled appointment.
Section 6 – Cancellations & Rescheduling
Appointments cancelled or rescheduled with less than twenty-four (24) hours notice may be subject to cancellation fees or forfeiture of deposits.
Deposits, if required, reserve appointment availability and may be non-refundable depending on the timing of cancellation.
Section 7 – Satisfaction Guarantee
We strive to provide high-quality cleaning services and customer satisfaction.
If you are dissatisfied with any portion of the Services, you must notify us within forty-eight (48) hours of service completion. We will make reasonable efforts to resolve the issue, including offering a re-clean where appropriate.
If we are unable to reasonably resolve the issue through a re-clean, we may issue a partial or full refund at our discretion.
Section 8 – Damage & Claims
Customers must report any damage, breakage, or service concerns within forty-eight (48) hours after completion of service.
BestNest Cleaning is not responsible for damage resulting from:
• Pre-existing conditions
• Improperly installed fixtures
• Unstable or fragile items
• Undisclosed specialty surfaces or materials
• Normal wear and tear
Customers are responsible for securing valuables, fragile items, firearms, cash, jewelry, and irreplaceable personal belongings before service begins.
Section 9 – Workplace Safety & Refusal of Service
The safety of our staff is extremely important.
We reserve the right to refuse or discontinue Services where conditions are unsafe, unsanitary, threatening, involve bodily fluids, hazardous waste, pest infestations, hoarding conditions, mold contamination, or otherwise present unreasonable risk to our staff.
We do not provide:
• Biohazard cleanup
• Mold remediation
• Pest removal
• Cleaning beyond safe ladder reach
• Hazardous material disposal
Section 10 – Pets
Customers are responsible for securing and supervising pets during service appointments.
BestNest Cleaning is not liable for incidents involving pets except in cases of gross negligence.
Section 11 – Reviews & Customer Feedback
We value honest customer feedback and appreciate reviews that accurately reflect your genuine experience with our Services.
Section 12 – Non-Solicitation of Workers
Customers agree not to directly hire, solicit, or contract with BestNest Cleaning employees or contractors outside of BestNest Cleaning for a period of twelve (12) months following the last date of service.
Violation of this provision may result in liquidated damages of $1,000 per occurrence.
Section 13 – Photography & Marketing
We may request permission to take before-and-after photographs for quality control or marketing purposes.
No personally identifying information will be shared without consent.
Section 14 – Intellectual Property
All website content, branding, logos, graphics, and written materials associated with BestNest Cleaning remain the intellectual property of BestNest Cleaning and may not be copied or used without written permission.
Section 15 – Disclaimer of Warranties
Services are provided on an “as-is” basis to the fullest extent permitted by law.
While we strive to provide professional and high-quality service, we do not guarantee perfection or uninterrupted availability of Services.
Section 16 – Limitation of Liability
To the fullest extent permitted by law, BestNest Cleaning shall not be liable for indirect, incidental, special, or consequential damages.
Our total liability for any claim relating to the Services shall not exceed the total amount paid by the customer for the specific Services giving rise to the claim.
Section 17 – Indemnification
Each party agrees to indemnify and hold harmless the other party from claims, damages, liabilities, costs, and expenses arising from breaches of these Terms or misuse of the Services.
Section 18 – Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Florida.
Except where prohibited by law, any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in Broward County or Miami-Dade County, Florida, at BestNest Cleaning’s discretion.
The prevailing party in any dispute shall be entitled to recover reasonable attorneys’ fees and costs.
Section 19 – General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
Failure to enforce any provision of these Terms shall not constitute a waiver of rights.
These Terms constitute the entire agreement between the parties regarding the Services provided by BestNest Cleaning.
